US Supreme Court Forces the Hand Of The WVA State Court

The Supreme Court of the United States in the case of Marmet Health Care Center, Inc. V. Clayton Brown posted some large breakthroughs in P.I. cases where nursing homes are a contributing factor. In a monumental ruling, it was found that state and federal courts are compelled to keep the ruling of the FAA in regards to all contracts of arbitration mandated by the FAA.

This time around, the Supreme Court of Appeals of West Virginia misinterpreted and didn’t pay attention to the precedents preceding reading the Federal Arbitration Act and broke the rules of the simple principles which mandate federal law implementation. The WV court disregarded the common mandates when dealing with strong allegations of personal injury and / or negligence against nursing homes. The FAA in black and white outlines that any contract making either person to settle all claims in court, and forcing the court costs on 1 of the parties is against the FAA.

The end result? The US Supreme Court determined that the FAA stood and the State Court had to follow federal guidelines and retry the hearings based on that.
